35 years on, justice secured for birth injury survivor.
In 2019, our team successfully settled a landmark case (X v HSE) involving a man who sustained brain injury at birth in 1984. His mother experienced a serious haemorrhage during labour, but delays in delivering him by emergency caesarean section led to hypoxic brain damage. The injury resulted in a lifelong disability – spastic quadriplegia and developmental delay.
The case required decades of medical records to be analysed and over a dozen independent experts to assess the standard of care and link it to the injury sustained. Although the hospital denied wrongdoing, the case settled during trial for €3.5 million, providing lifelong support and care for our client.
