Birth Injury, Autism and Delayed Intervention

Case Study: June 2023

Awareness of autism has grown significantly in recent years, helping to foster greater understanding and support for those affected. For one young boy, however, the circumstances of his birth left him facing lifelong challenges. Six-year-old Nate Tutty from Waterford sustained injuries during his delivery that were later found to have long-term consequences, including autism, non-verbal communication, and behavioural difficulties. His case centred on the hospital’s failure to perform an emergency caesarean section in time to prevent oxygen deprivation and trauma at birth.

Acting for Nate and his family, we pursued a claim against the HSE that resulted in an interim settlement of €1.4 million to meet his care needs for the next six years, with the HSE accepting 70% liability. The outcome provides crucial security for his future therapies, education, and support. Nate’s mother has since spoken publicly, encouraging other parents to trust their instincts and seek answers when something feels wrong. This case stands as a powerful reminder of the lifelong impact of birth injuries and the importance of accountability, compassion, and care in every delivery room.
