Case Study: October 2024
We represented a young girl who suffered catastrophic brain injury at birth at the Coombe Women & Infants University Hospital and who now requires full-time care. In October 2024, the High Court approved an interim settlement of €5 million to meet her needs for the next six years. The case was brought against the HSE and Children’s Health Ireland, with both defendants admitting liability.
During the hearing, the Court heard how the hospital’s failure to properly manage her delivery caused oxygen deprivation and irreversible damage. The hospital issued an unreserved apology to the girl’s parents, acknowledging the harm caused and the lifelong impact on their family. The judge commended the parents’ devotion to their daughter’s care, noting their strength in ensuring she receives the support she deserves.
This case highlights the enduring impact of avoidable birth injuries and the importance of openness and accountability within the healthcare system. It also reflects our continued commitment to achieving justice for children and families affected by medical negligence, ensuring their future care and dignity are protected.
