Case Study: May 2024
In May 2024, we achieved a €1.14 million High Court settlement on behalf of a young boy who suffered injuries at birth in University Maternity Hospital Limerick. The settlement, covering his needs for the next five years, will return to court thereafter for assessment of his future care.
The boy, now living with autism and developmental delay, was alleged to have been deprived of oxygen during delivery, resulting in hypoxic ischaemic encephalopathy. Despite the HSE’s denial of liability, we demonstrated significant failures in antenatal monitoring and labour management. The Court commended his parents for their extraordinary care and resilience in the face of immense challenges.
This Cian O’Carroll Solicitors‘ case highlights the lifelong impact that birth-related injuries can have and the essential role of persistence, expertise, and compassion in achieving justice for children and families affected by medical negligence.
