Case Study: July 2021
Cian O’Carroll Solicitors acted for a 12-year-old girl whose rare childhood disease, Langerhans Cell Histiocytosis (LCH), went undiagnosed for 16 months during her early years. This delay, at a time when the disease was most aggressive, caused serious and permanent brain injury. Her case, brought against the HSE, was described by Mr Justice Kevin Cross as one of the most complex medical negligence cases he had ever encountered.
Building the claim required analysis of vast medical records and input from more than 20 independent experts, including a leading paediatric oncologist. Their evidence confirmed that timely diagnosis and treatment would have prevented much of the damage. In July 2021, we secured a €4.9 million settlement, ensuring lifelong provision for nursing care, adaptive housing, and essential support. This outcome gave her family both recognition and the security needed to plan for her future.
