Delayed Cancer Diagnosis Leads to Loss of Chance of Survival: A Successful Medical Negligence Claim.
Navigating a cancer diagnosis can be an incredibly challenging time, and ensuring timely and accurate diagnosis is crucial for effective treatment and the best possible outcomes. Unfortunately, delays or failures in diagnosis can occur, sometimes leading to the necessity of more aggressive treatment and impacting a patient’s chance of survival.
Our firm recently represented a young man who tragically experienced such a situation. He was diagnosed with adenocarcinoma of the oesophago-gastric junction after his symptoms were missed by two General Practitioners over several years. It was alleged that both GPs failed to ensure adequate follow-up or investigation of his symptoms, specifically by not referring him for an upper gastrointestinal endoscopy. Following his eventual diagnosis, the client underwent neoadjuvant radiochemotherapy and thoracoscopic oesophagectomy.
However, due to the delay in diagnosis and treatment, he suffered a severe loss of amenity of life and a loss of chance of survival. He was advised that his life expectancy was approximately 18 months with palliative treatment. We successfully concluded his complex medical negligence claim within two months of bringing it before the High Court, securing a significant sum in damages through expedited case management and mediation. To build a strong case, we obtained extensive treatment records and consulted with 12 independent experts within a short timeframe.
The Defendant GPs contested the claim, arguing that the client’s management and outcome would have been the same even with an earlier diagnosis. However, our client’s independent medico-legal experts disagreed, asserting that an earlier diagnosis would have made a material difference to the outcome. Sadly, our client’s disease progressed aggressively, and he passed away five months after the mediation. The settlement provided financial security for his wife and daughter. His family later shared with us that our support had provided him with hope and validation when others had doubted him. This case highlights the critical importance of thorough investigation and timely referral when patients present with concerning symptoms.
