Case Study: February 2023
In February 2023, Paul Kelly at Cian O’Carroll Solicitors concluded a significant High Court medical negligence case on behalf of a 12-year-old boy from the West of Ireland, arising from events at the time of his birth.
The case resolved for €2 million to age 18, with provision for a further assessment of compensation when he reaches adulthood. This structure reflects the ongoing and evolving nature of his care needs and will ensure ongoing provision for his needs throughout his life.
Background to the Case
The Plaintiff brought proceedings against the HSE alleging that negligent care at the time of his birth caused him to develop Autism Spectrum Disorder, together with learning disability and behavioural difficulties.
These conditions have had a profound impact on his development and daily life, requiring significant support from an early age.
The case raised complex issues of both medicine and law. In particular, it required consideration of whether there could be a causal link between events at birth and the later development of Autism Spectrum Disorder.
This remains an emerging and evolving area, with no Irish court having previously confirmed such a link.
Medical and Legal Complexity
Given the nature of the claim, extensive expert evidence was required.
Fourteen independent medical experts were retained on behalf of the Plaintiff to address issues of causation, standard of care and long-term prognosis.
As is often the case in developing areas of medicine, there were competing views as to the origin of the Plaintiff’s condition and whether it could be attributed to events at birth.
The HSE fully defended the proceedings and denied any wrongdoing, maintaining that there had been no negligence and no causal connection.
Resolution
The case was resolved following mediation, which took place one week prior to the scheduled High Court hearing.
The settlement provides:
- €2 million in compensation to age 18
- A further High Court assessment at age 18 to determine compensation for the remainder of his life
- An agreement that two-thirds of the future claim (post-18) will be payable by the HSE, either by agreement or Court order
The case was concluded within approximately 18 months.
Impact of the Settlement
This prompt resolution ensures that the Plaintiff’s immediate needs can now be addressed.
The compensation will provide access to private therapies, specialist supports, and necessary aids and appliances that will assist him in his daily life.
It will also provide meaningful support to his parents in managing the ongoing demands of caring for a child with additional needs.
Conclusion
This case highlights the complexity of claims involving developmental conditions such as Autism Spectrum Disorder, particularly where causation is disputed and medical understanding continues to evolve.
While each case turns on its own facts, it demonstrates that, with appropriate expert evidence and careful legal analysis, it is possible to successfully resolve such claims and secure important supports for children and their families.
If you have concerns regarding the circumstances of a birth or a child’s development, it may be appropriate to seek specialist advice.
