Case Study: May 2023
In May 2017, Nicolina and Dermot Clavin’s son, Jack, was born at the Coombe Hospital. Following a ventouse-assisted delivery, Jack suffered a subgaleal haemorrhage and subdural haematoma that went undiagnosed and untreated. Jack, who also has haemophilia, subsequently suffered a stroke requiring emergency surgery at Temple Street Hospital. These failures led to Jack developing cerebral palsy, learning difficulties, and Autism Spectrum Disorder.
Jack’s case was among the most significant medical negligence actions ever brought in Ireland. It required the instruction of 18 expert witnesses and was fully defended up until just a week before trial. Only then did the Defendants concede fault, with the Master of the Coombe Hospital issuing an unreserved apology for the failings that caused Jack’s injuries.
In May 2023, Jack’s case settled for €6 million to age 18, with the guarantee that at adulthood the Defendants will cover 100% of his future care costs for life. This makes it one of the largest settlements of its kind in the history of the State.
While no settlement can undo the harm caused, this outcome ensures that Jack will have the lifelong care and support he needs, bringing his parents and sister peace of mind for the future.
