RE (a minor) – Negligent Care Case

Case Study: May 2023

In early 2015, RE was born prematurely. His case was unique – it did not involve autism, cerebral palsy, or any recognised intellectual disability. Instead, RE developed dyslexia and memory difficulties, which his parents believed were linked to negligent care before and after his birth.

Cian O’Carroll solicitors argued that RE’s mother should have received protective medications – corticosteroids and magnesium sulphatE, on admission to hospital, and that RE was deprived of oxygen in the hours leading up to his delivery. The hospital disputed negligence, maintaining that RE was “neurotypical” and that his difficulties were unrelated to the care he received. However, they did acknowledge failings during resuscitation after birth, when nine attempts were required to intubate him.

Despite these challenges, RE’s parents brought a strong case to the High Court. Just before trial in May 2023, the case settled on an interim basis. RE was awarded €500,000 to age 18, with an agreement that 50% of his future care costs will also be provided for the rest of his life, either by agreement or determination of the High Court.

This outcome ensures RE will have access to the private care and educational supports he needs, while giving his parents peace of mind about his future.
