Settlement Secures Future for Young Man Following Complex Birth Injury Autism Case

Case Study: October 2025

Today, 15th October 2025, the High Court approved a substantial interim settlement in the case of BN, represented by Cian O’Carroll solicitors, arising from negligent management of his birth which left him with lifelong disabilities.

BN, who is now an adult, sustained hypoxic-ischaemic encephalopathy (HIE) after oxygen deprivation during delivery, leading to autism, epilepsy and moderate intellectual disability. While the defence sought to attribute his condition to a rare genetic variant, our expert team demonstrated that this could not explain the full extent of his injuries.

After extensive preparation and collaboration with international medical and genetic experts, the case was resolved at mediation shortly before trial. The settlement, running into multiple millions, secures BN’s specialist care, therapies and supports for the next five years, with a return to court scheduled to review his lifelong needs.

At the approval hearing, the High Court judge commended BN’s parents for their “heroic” devotion and described the agreement as “a very reasonable and forward-looking resolution,” recognising the potential for continued medical and therapeutic progress.

This outcome ensures BN will have the resources he needs to live with dignity, security and the opportunity to achieve his best potential; the very purpose for which his family brought this case.
